The Services offered by Future Simple d.o.o. as defined below, can only be used by Clients who have first read these General Terms and Conditions and accepted them unconditionally by clicking on the appropriate box provided for the purpose. It is not possible to proceed with the booking process without this acceptance. Clients undertake to fulfil the obligations contained within these terms and conditions. The agreement between Clients and Future Simple d.o.o. comes into force as soon as Future Simple d.o.o. provides written confirmation of a booking to Clients by email.
Clients should save and/or print a copy of these terms and conditions for future reference when making a booking.
These General Terms and Conditions are governed by the laws of the Republic of Croatia. The Client agrees that the Croatian Courts shall have jurisdiction to hear and determine any dispute arising from the interpretation and/or arising here from.
Definitions
The following definitions have the same meaning whether they are singular or plural.
'Client'means a Client who books one or more Services offered on the Website.
'Destination Service'means the offering of tickets to events or tourist attractions at travel destinations, transport services and other services other than those included in Travel package.
'Future simple d.o.o.'limited liability company Future Simple, whose registered office is at Zagreb 10000, Avenija Dubrovnik 17, Croatia.
'Papaya travel'is the name of the web site providing booking service.
'General Terms and Conditions'means these general terms and conditions for booking and use, as amended from time to time.
'Location'means Novalja and Zrce beach, Island of Pag, Republic of Croatia.
'Travel Package'means a Service that generally includes standard accommodation, festival ticket, goodie bag and complimentary drinks.
'Rules and Restrictions'means the terms and conditions applicable to the Suppliers with whom the Client has concluded a separate contract.
'Service'means all services offered on the Website, such as accommodation service, festival tickets, Destination Services, insurance and package holidays.
'Supplier'means a supplier of Services, such as car hire company, insurance provider or Destination Service supplier such as bungee jumping etc.
'Website'means the means the www.travel.papaya.com.hr website.
The General Terms and Conditions are a part of main contract between Future Simple d.o.o. and Clients who are booking Travel packages or accommodation services.
These General Terms and Conditions apply to offering and providing of the Services by Future Simple d.o.o. operates the Website which acts as an interface between the Client and the various Suppliers offering the Services.
These General Terms and Conditions are subject to the Suppliers' Rules and Restrictions which are made available to the Client before any booking is completed and which the Client also accepts at the moment that a booking is actually placed. It is the Client's responsibility to familiarise himself/herself with the Suppliers' Rules and Restrictions.
The General Terms and Conditions can be changed by Future Simple d.o.o. at any time without prior notice, although such changes will not apply to bookings that have already been accepted by Future Simple d.o.o. It is therefore essential that the Client reads, saves and/or prints a copy of the General Terms and Conditions at the time the booking is placed, in order to be aware of the provisions in force.
All the arrangements offered by Papaya Travel, are primarily dedicated to university and college students and to youth in general. Once a Client orders a certain Travel package arrangement from Papaya Travel, by telephone or on-line via Papaya Travel portal, it is considered that he has accepted these General Terms and Conditions. The booking made by Client is obligatory whether the order is given orally over the phone or in writing on-line. Therefore it is only possible for a Client to cancel the booking in accordance with these General Terms and Conditions. The Client is responsible for all the costs and consequences, which may occur due to incorrect information he or she provided when making a booking.
The descriptions on the Website specify the Services included in the price for each package or accommodation. Prices are shown in Euro. All the prices of Papaya Travel include value added tax. All payments will be effected in Euro. Prices in other currencies published on Papaya Travel’s web sites are only for information (according to the middle exchange rate by Croatian National Bank on the payment date). Papaya Travel reserves the right to change the prices according to Croatian Civil Obligations Act (the changes take place due to changes in currency exchange rates, changes in transport tariffs, changes in fuel prices…). Should price changes occur, Papaya Travel has the responsibility of informing the Client no later than 20 days prior to the day of arrival. If the agreed price of the Travel package arrangement rises more than 10%, it is the right of the Client to cancel his booking without any further cost; this must be done within 2 days following the receipt of the notice of the price change.
The Client should be aware that the local authorities in Croatia impose additional taxes (tourist tax), which has to be paid locally. The Client is exclusively responsible for paying such additional taxes.
Unless expressly stated otherwise, prices do not include insurance, transport, visa and any personal expenses (laundry, telephone, drinks, room service, tips, etc.), nor excursions or the use of facilities, nor any more general costs that are not expressly included in the confirmation of reservation.
If Papaya Travel becomes aware of or is notified of any fraud or illegal activity associated with the payment for the booking, the booking will be cancelled and the Client will be liable for all the expenses arising from such cancellation, without prejudice to any action that might be taken against him / her.
Primarily, Travel package includes standard accommodation, festival ticket, goodie bag and free cocktails. complimentary drinks.
Accommodation may be offered separately or as part of a package holiday. Prices shown on the Website do not include any fees or charges for optional supplements or final handling &booking fees which are added at the end of the process.
If a Client does not show for the first night of the reservation and plans to check-in for subsequent nights in the reservation, the Client must confirm the reservation changes with Papaya Travel no later than the original date of check-in to prevent cancellation of the whole reservation. If the Client does not confirm the reservation changes with Papaya Travel the whole reservation may be cancelled with no refund.
The Client is reminded that, in general, rooms are only available from 15.00 and have to be vacated by 10:00, irrespective of the time of arrival or departure or the means of transport used.
Single rooms generally have one bed and a supplement is often payable for these rooms. Double rooms usually have either two single beds or one double bed.
Papaya Travel does its utmost to provide photographs and illustrations that give the Client a depiction of the accommodation and Services offered. The purpose of these photographs and illustrations is to show the Client the level of accommodation and the degree of comfort, and they must not be considered to be making any representation that exceeds this purpose. Photos and description of accommodation advertised at Papaya Travel portal are sample and actual appearance of accommodation may vary from photos.
If, for any number of reasons, the accommodation reserved by Client isn’t available upon his or her arrival, Papaya Travel is obligated to offer equal or better accommodation to such Client.
The Client will be requested to pay “Damage deposit” from 100€ to 500€ as insurance for potential damages to accommodation, and if any damage occurs, the Client will be requested to reimburse such damage if the deposit is not sufficient. Papaya Travel personnel will check the accommodation’s condition and inventory list at the check-in and at the check-out. Before checking-out the Client has to pay for all damages or missing objects from accommodation.
Papaya Travel is not responsible for Clients using alcohol or drugs inside accommodation and is not responsible for any injuries happened in accommodation.
Travel package includes a festival ticket. Papaya Travel is not the organizer of festivals or events and therefore is not responsible and cannot be held responsible if the festivals are cancelled. If the festival organizer decides to return the ticket money, in whole or partially, Papaya Travel can refund ticket money.
Refund of ticket purchased is not possible in the case of partial cancellation of the festival.
Travel package includes goodie bag. Goodie bag contains a souvenir gift and it will be given to the Client upon his/her on arrival at the accommodation or no later than three days upon his/her on arrival at the accommodation.
Travel package includes a free cocktail. More specifically, the price of the Travel package includes three free cocktails per day per person at Papaya Club.
Destination services are not included into the Travel package and they are set up as services upon additional payment (shuttle bus transport, boat party, insurance, bungee jumping, etc …). These services are to be paid by the Client separately to the Supplier. The Client may be charged by more than one party in respect of a booking, for instance, by Papaya Travel and a Supplier or such other party as may appear on Client’s credit card or bank statement, depending on the Services booked. However the total amount charged will not exceed the total price of the Services.
Upon request, Papaya Travel offers organization of shuttle bus transportation from airport to accommodation. Papaya Travel is not responsible for any delays caused by the shuttle bus.
Papaya Travel also advertises other activities available at the Location such as clubbing offers, adrenaline activities, nature sightseeing and excursions. When offering and advertising such activities Papaya Travel operates the Website which acts as an interface between the Client and the various Suppliers offering the Services. Papaya Travel is not Supplier of such services and is not responsible for such services in any sense whatsoever.
The Website helps the Client to find travel products and to make the necessary reservations, and acts as an interface in the transactions involved with the Suppliers. The Client must be at least 18 years old, be legally authorised to enter into contractual obligations, have the requisite consent or authority to act for or on behalf of any persons included in a booking and must use the Website in accordance with these General Terms and Conditions and the Website Terms of Use.
The Client is responsible for his / her activities on the Website (financially or otherwise), including the possible use of his / her user name and password. The Client guarantees that the information entered by him / her on the Website in relation to him / her and, if applicable, his / her travelling companions is accurate.
Any use of the Website that is fraudulent or is in conflict with these General Terms and Conditions shall be reason for refusing the Client access to the Services offered by Papaya Travel and the Suppliers or to the other functionalities of the Website.
The Client can book Travel package at the Papaya Travel office, in any other accredited agency, by telephone or online at www.travel.papaya.com.hr. When executing booking Papaya Travel and the Client agree to a binding agreement, which includes all information regarding the Travel package arrangements that the Client has chosen.
There are two possible ways of paying for your Travel package – paying the full amount immediately during your booking process or using the 30% deposit option.
When booking the deposit option, the Client has to pay 30% of the full price amount immediately and provide all necessary information and his personal documents that are required. The Client has to pay the remaining amount (70%) of the chosen Service no later than 14 days before the starting date of his journey. For all Travel packages that execute more than 21 days after the day’s date, it is possible to pay down payment of 30% and the remaining amount of the full price of Service no later than 14 days before its starting date. If the Client fails to complete his reservation and doesn’t pay the full price 14 days prior the journey’s starting date, Papaya Travel agency system will automatically cancel the Client’s booking. In any case of cancellation, the 30% down payment (deposit) is non-refundable.
Online payment enables the information containing the card number and CCV code to be inserted exclusively on the bank’s secure webpage. All the card information remains in the domain of bank and Papaya Travel as the merchant does not have access to this information. When making an on-line payment by credit card the Client is redirected to the website in the domain of the card processing center and the bank to which the Papaya Travel has made the contract with to use credit and debit cards.
Secure payment service executed through the international card systems Visa and MasterCard. The trademarks Verified by Visa and MasterCard SecureCode enable the Client to electronically sign every purchase he makes online simply by using his smart card, portable card reader and the single use password. Thus owners of the credit or debit cards are offered the most secure online payment systems currently available on the market, regardless of the credit or debit card they use. Payments are possible with any of the following credit or debit cards: MasterCard, Maestro, Visa, Visa Electron and American Express.
Confirmation of a booking, which includes the essential elements such as the description of the Service(s) booked and the price, will be sent to the Client by e-mail. If the Client does not receive a confirmation e-mail within 24 hours of placing the booking, he / she should contact Client Services at travel@papaya.com.hr.
It is expressly agreed that the data stored in the information systems of Papaya Travel and / or its Suppliers shall constitute proof with respect to the bookings made by the Client. Data stored in computers or electronic media are valid proof, and shall therefore be acceptable under the same conditions and with the same evidential value as a physical written document.
All requests for amendments and cancellation will be dealt by Papaya Travel and with the Suppliers concerned. The Client does not have an automatic right to cancel a booking unless the Supplier provides for this in the Rules and Restrictions.
In the event of cancellation or partial cancellation of a booking by the Client, compensation may be required from the Client to cover the costs and damages. In addition to this, charges may be imposed by the applicable Suppliers. Where a cancellation affects more than one person on the booking, any applicable cancellation charge will be applied in respect of each person on the booking. In some cases, compensation for cancellation payable to the applicable Suppliers can amount to the full value of travel booked, so that no reimbursement to the Client is made.
Papaya Travel will impose its own standard 12 Euro administration fee in the event of amendment after the booking has been made (upon filling in the booking form), if such amendment is possible. Such fee does not exclude other charges.
If the Client does not present himself / herself at the departure of the trip, no refund will be due to the Client.
Should the Client cancel the booking Papaya Travel reserves the right to claim from the Client all the costs of such cancellation. The amount of costs depends on the date on which the written booking cancellation was received. Unless otherwise stated in the booking arrangements, the following cancellation terms are to be considered as valid:

Failure to arrive at the check in will be treated as Client’s cancellation and full payment will be due, in accordance with cancellation policy.
If a Client misses his plane due to late arrival or departure of the bus for any reason, the Client will not be entitled to a refund of any kind. Papaya Travel cannot be held responsible for late arrivals due to traffic, accidents or weather conditions.
If Client’s booking is being cancelled by Papaya Travel, Client’s money will be refunded, but Papaya Travel will accept no responsibility for alternative accommodation arrangements.
A registered participant in a trip can be replaced by a third party if Papaya Travel is informed of this at least 15 days before the start of a trip. However, Papaya Travel can object to the change of traveller. If a replacement person enters into the contract, then the Client, together with that replacement person, are jointly and severally responsible for the cost of the trip and any additional costs (12 Euro Papaya administration fee) arising from the inclusion of the third party and including any cost to Papaya Travel for making the change.
Papaya Travel will inform Clients immediately of changes or differences to their travel arrangements. Changes or differences to the travel arrangements that become necessary after the booking is done and are not brought about by Papaya Travel in bad faith are permitted insofar as the changes or differences are not significant and they do not affect the overall character of the trip booked. The same rights apply to the altered arrangements as applied in respect of the original arrangements.
Papaya Travel is not responsible for the theft or damage of the Client’s luggage or other personal belongings, valuables and documents that the Client carries with him or leaves in the provided accommodation.
Complaints based on implementation of the Service not being in accordance with the contract should be submitted within 15 days of the contractually-scheduled end of the Service. In that case, contact travel@papaya.com.hr. Complaints should be made in writing. The limitation period begins on the day on which the Service ended. A Client has to inform of all irregularities and deviations from the agreed. Papaya Travel will not consider complaints arrived after the said period of 15 days and oral complaints.
Papaya Travel is neither the organizer nor the holder of Papaya Club. All complaints regarding the Festival organization, the facilities or the venue as such must be done at the spot of Papaya Club.
All complaints regarding the Domestic Services must be done at the Location immediately.
Weather conditions are considered to be “force majeure” and are not subject of the responsibility of Papaya Travel, and as such do not provide any right for a refund.
Shuttle Bus & Airport transfers departure times may change due to force majeure, heavy traffic and other extraordinary conditions. All complaints must be expressed on the spot to Suppliers. Papaya Travel cannot be held responsible for such Services.
The booking price does not include insurance and Client is therefore advised to take out insurance that covers the consequences of cancellation and additional policy that provides cover for risks such as the cost of repatriation in the event of an accident or illness, and insurance for cases of accident and illness during the trip and luggage insurance. When travelling abroad it is recommended to obtain health insurance with global coverage. Papaya Travel organizes insurance services upon Client’s request (health, accidents, cancellations, luggage…)
While booking on the Website Clients will be charged with Booking fee and Handling fee.
Local Tourist tax is not included in the price and the Client is obliged to pay such according tax upon his/her on arrival at the accommodation.
By acceptance of this Terms and Conditions, every Client gives Papaya Travel his or hers permission to use photographs and videos made during visit at the Location (the photographs and videos could include every Client) for promotional and commercial use. Papaya Travel does not take any responsibility for the behavior of other Clients and damages Clients might cause to each other during at the Location.
Papaya Travel does not take responsibility for errors in the promotional material (catalogues, leaflets and websites).
